1. CANCELLATIONS - In the event of a job cancellation the client is charged for the portion of the job already completed plus an additional 10% cancellation fee for the liquidation of damages.

2. CLAIMS, ADJUSTMENTS, & ERRORS - All claims, requests for adjustments, or notification of error(s) must be made within two (2) business days of receipt of product, or charges will be considered accepted by customer. Billing errors are not covered by this section (see separate credit agreement).

3. CLIENT SPECIFICATIONS - It is the client's responsibility to properly prepare all files for output, include all relevant supporting files for a specified job and to properly disclose all pertinent information concerning such files submitted using approved forms and formats. Client may be charged an additional fee and charged for waste output created due to omissions and/or inadequate preparation of files.

4. DELIVERIES - All deliveries are the client's responsibility and made at the client's expense by the method of return shipment that Icons & Images, Inc. deems appropriate at the time of such shipment, unless otherwise specified.

5. LIABILITY - Icons & Images Incorporated's responsibility to the customer for computer imaging services is limited to converting customer's computer files or designs into graphic products (transparencies, hardcopy, magnetic media, etc.). Icons & Images, Inc. assumes no responsibility for the content of a computer image nor the file structure which may create errors in appearance, format, size, color, etc. or the loss of data or property while in the possession of or in transit either to or from Icons & Images, Inc.

SUBMITTING ANY MATERIALS TO ICONS & IMAGES, INC. FOR IMAGING SERVICE OR ANY OTHER PURPOSE CONSTITUTES AN AGREEMENT BY THE CUSTOMER THAT ANY DAMAGES TO OR LOSS OF SUCH MATERIALS BY ICONS & IMAGES, INC. ITS AGENTS, EVEN THOUGH DUE TO THE NEGLIGENCE OR OTHER FAULT OF ICONS & IMAGES, INC. OR ITS AGENTS, WILL ONLY ENTITLE THE CUSTOMER TO THE REPLACEMENT OF SUCH MATERIALS WITH A LIKE AMOUNT OF UNUSED MATERIALS PLUS HANDLING OR IMAGING CHARGES. EXCEPT FOR SUCH REPLACEMENT, THE ACCEPTANCE BY ICONS & IMAGES, INC. OF SAID MATERIALS IS WITHOUT ANY WARRANTY OR LIABILITY AND RECOVERY FOR ANY INTRINSIC VALUE OR INCIDENTAL OR CONSEQUENTIAL DAMAGES IS EXCLUDED. THIS LIMITATION OF LIABILITY MAY ONLY BE WAIVED BY AN OFFICER OF ICONS & IMAGES, INC. IN WRITING.

6. PAYMENT TERMS - Icons & Images accepts major credit cards for payment. Other payments may be made by money order or check, payable in United States dollars (US$) through a United States bank to Icons & Images, Inc. Commercial credit is available for qualified customers with a completed and approved credit application. Further terms and conditions for those applying for and with approved credit are included in a separate agreement.

7. RATE & POLICY CURRENCY - All orders submitted to Icons & Images, Inc. are billed according to current rates and policies. It is the clients' responsibility to obtain information on the latest rates and policies.

8. SOFTWARE - Icons & Images, Inc. is not liable for any software offered-software is offered "as-is" and use of such software is at client's own risk.

9. TAXES, TARIFFS, & DUTIES - It is understood that the client is responsible for all taxes, tariffs, and duties associated with the production and delivery of a specified order.

10. TURNAROUND TIME - Turnaround is defined as the maximum time period Icons & Images, Inc. will take to process a client's order. Turnaround time does not have any bearing on the actual shipment of specified jobs. Rush and super rush service is available at an additional charge. Icons & Images, Inc. does not guarantee such service and/or will not be held responsible for events beyond its' control, including but not limited to mechanical and computer failures. It is the client's responsibility to check with Icons & Images, Inc. on the availability of specific turnaround times.

11. ACCEPTANCE OF TERMS - Placement of an order with Icons & Images, Incorporated constitutes agreement of all terms and conditions.

CREDIT AGREEMENT - Additional terms apply to those with approved commercial credit. Consult your commercial credit application and terms for more detail.
